US federal judge Karin Immergut has issued a temporary stay on the deployment of the National Guard to Portland, a decision seen as a major legal setback for President Donald Trump’s administration.
President Trump has ordered the deployment of the National Guard to deal with ongoing protests near an Immigration and Customs Enforcement (ICE) facility in Portland. However, Oregon Governor Tina Kotek opposed the move and filed a lawsuit in court. A federal judge suspends the National Guard deployment in Portland last Saturday, because he felt that the situation in Portland was not serious enough to require federal intervention.
Following the judge’s order, the Trump administration decided to send National Guard members from California and Texas to Portland. About 200 California National Guard members arrived in Portland. However, Judge Immergut identified the move as a direct violation of his previous order and issued a new stay, which will remain in effect until at least October 19.
California Governor Gavin Newsom called the move an “abuse of power” and filed a lawsuit. “The rule of law has prevailed and the California National Guard is going home,” he said.
This legal battle will play an important role in determining the boundaries of state and federal government power in the United States. The judge’s order is seen as a major step in curbing the federal government’s abuse of power. The next hearing in the case is scheduled for October 17.
